These Terms of Service (the "Terms") govern your use of instafunds.co and the related services provided by InstaFunds LLC ("InstaFunds," "we," "us," or "our") to business owners seeking financing (the "Services"). By using the Services or submitting information to us, you agree to these Terms. If you do not agree, do not use the Services.
We help established businesses request financing. We review the information you give us and, with your authorization, submit it to one or more funding companies. Any decision to approve, decline, or make an offer is made by the funding company, not by us, unless we tell you otherwise in writing.
Checking whether you qualify, pre-qualifying, or submitting an application is not an approval, a commitment to lend, or an offer of financing. All financing is subject to review and approval. Not all applicants qualify, and amounts, pricing, and timing vary.
You may use the Services only if you are at least 18 years old, you are applying on behalf of a business operating in the United States, and you are an owner or are otherwise authorized to act for that business.
You agree to give us information that is true, accurate, current, and complete, and to update it if it changes. You confirm that you have the right to share the documents you submit, including business bank statements and information about other owners or guarantors.
By submitting an application, you authorize us to share your information with funding companies and service providers, and you authorize us and those funding companies to obtain business and consumer credit reports, as described in our Privacy Policy.
If a funding company makes you an offer, the terms of that financing, including any fees, are set out in the agreement you sign with that company. That agreement, not these Terms or anything on our website, controls your financing. Read it carefully before you sign. You are responsible for deciding whether a financing product is right for your business.
By giving us your contact information, you agree that we may contact you by phone, email, and, where you have opted in, text message about your request, your application, and available offers. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help. Funding companies and other third parties are independent businesses. We do not control and are not responsible for their decisions, products, terms, websites, or privacy practices.
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that you will be approved, receive an offer, or receive funding in any amount or within any time.
To the fullest extent permitted by law, InstaFunds and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from your use of the Services or from any financing you do or do not obtain. Some states do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold InstaFunds harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from information you submit that is false or that you had no right to share, or from your violation of these Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date. Your continued use of the Services after an update means you accept the updated Terms.
