Privacy Policy

Last updated: September 24, 2026

InstaFunds LLC (“InstaFunds,” “we,” “us,” or “our”) operates instafunds.co and the related services we provide to business owners seeking financing (the “Services”). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have.

InstaFunds arranges business-purpose financing only. We do not offer loans or financing for personal, family, or household purposes. We are not a bank. In most cases we are not the funder: we present your application to funding companies who decide whether to make you an offer.

1. Information we collect

Information you give us

  • Identity and contact details: name, email address, phone number, mailing address, and date of birth.
  • Business information: legal and trade name, EIN, entity type, industry, time in business, monthly revenue, ownership structure, business bank statements, and credit card processing statements.
  • Owner and guarantor information: Social Security number, ownership percentage, income, and personal financial details for each owner or guarantor named on an application.
  • Communications: text messages, emails, support correspondence, and recordings of phone calls where we record them (see Section 6).

Information we collect automatically

  • IP address, browser and device type, operating system, pages viewed, time on page, and referring URL.
  • Approximate location derived from your IP address.
  • Information collected through cookies, pixels, tags, and similar technologies (see Section 7).

Information we receive from others

  • Business credit reports from commercial bureaus, and consumer credit reports on owners and guarantors from consumer reporting agencies.
  • Identity verification and fraud prevention providers.
  • Bank account and transaction data through a connection service you authorize, such as Plaid, where that method is used.
  • Lead providers and marketing partners, including your contact and business details.
  • Public records, including UCC filings, liens, and judgments.
  • Funding partners, regarding the status and outcome of applications we submit for you.

2. How we use information

We use personal information to:

  • Evaluate your application and prepare it for submission to funding partners.
  • Verify identity and prevent fraud.
  • Communicate with you about your application, offers, and account.
  • Service and, where applicable, collect on funded accounts.
  • Send you marketing communications, where permitted by law and by your consent.
  • Operate, secure, analyze, and improve the Services.
  • Comply with legal obligations and enforce our agreements.

3. How we share information

Funding partners. This is central to how our service works. When you apply, we submit your application and supporting documents, including your business bank statements and owner information, to one or more funding companies so they can evaluate your request and make offers. We decide which funders receive your file based on your business profile. Each funder receives your information as an independent company and handles it under its own privacy policy, which we do not control. If you do not want your information sent to funders, do not submit an application.

  • Service providers. Vendors that provide underwriting tools, identity verification, document storage, cloud hosting, CRM and communications platforms, telephony and text messaging, analytics, e-signature, and customer support. They may use your information only to provide services to us.
  • Credit reporting agencies. We may report account information to business credit bureaus.
  • Advertising and analytics partners. See Section 4.
  • Legal and safety. To comply with law, legal process, subpoenas, or regulatory requests, and to protect our rights, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
  • With your direction. When you ask us to share information with someone.

4. Advertising, and what “sale” and “sharing” mean here

We do not sell your personal information for money.

We do use advertising and analytics technologies on our website, including tools provided by Meta and Google. These tools may set cookies or identifiers that let those companies recognize your device and help us measure and target advertising. Under California, New Jersey, and several other state privacy laws, that activity can be treated as “sharing” personal information for cross-context behavioral advertising, and in some states as a “sale,” even though no money changes hands.

We do not use this technology to share your application contents, bank statements, Social Security number, or other sensitive information with advertising partners.

You can opt out at any time by emailing [email protected] with “Opt out of advertising” in the subject line, by adjusting your browser cookie settings, or by enabling a Global Privacy Control signal in your browser, which we honor where required by law.

5. Text messaging

If you opt in to receive text messages from InstaFunds, you may receive messages about your application, your account, and available offers. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Consent to receive text messages is not a condition of any purchase or of receiving funding.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. This excludes service providers that help us deliver messages on our behalf.

6. Calls and email

We may contact you by phone, including through automated dialing technology, and by email, where you have consented or as otherwise permitted by law.

We record some calls for quality, training, and recordkeeping. Where the law requires notice or consent, we disclose the recording at the start of the call, and you may ask us not to record.

To stop marketing emails, use the unsubscribe link in any marketing email. To stop marketing calls, ask to be added to our internal do-not-call list, or contact us using Section 14. We may still send you messages about an active application or an open account.

7. Cookies and tracking

We and our partners use cookies, pixels, tags, and similar tools to operate the site, remember your preferences, measure performance, and support advertising. Most browsers let you block or delete cookies through their settings. Blocking some cookies may affect how the site works.

Do Not Track. Our Services do not currently respond to browser Do Not Track signals.

Global Privacy Control. Where required by law, we treat a Global Privacy Control signal as a valid request to opt out of sale, sharing, and targeted advertising for that browser.

8. Credit reports and your authorization

By submitting an application, you authorize InstaFunds and the funding partners we submit your application to, to obtain business credit reports on your company and consumer credit reports on you personally as an owner or guarantor. These reports may be obtained for underwriting, account review, and collection purposes, as permitted by the Fair Credit Reporting Act.

If an application is declined based in whole or in part on information in a consumer report, you are entitled to notice identifying the reporting agency that supplied it. That agency did not make the decision and cannot explain it, but you may request a free copy of your report from them.

9. Your privacy rights

Depending on where you live, including California, New Jersey, and other states with comprehensive privacy laws, you may have the right to:

  • Know what personal information we hold about you and access a copy of it.
  • Correct inaccurate personal information.
  • Delete your personal information, subject to legal exceptions.
  • Receive a portable copy of your personal information.
  • Opt out of the sale or sharing of your personal information, and of targeted advertising and certain profiling.
  • Limit the use and disclosure of sensitive personal information, such as your Social Security number.
  • Not be treated differently for exercising any of these rights.

How to make a request. Email [email protected] or call (908) 913-6625. We will take reasonable steps to verify your identity before responding, and we respond within 45 days unless the law allows us an extension, in which case we will tell you. You may use an authorized agent who provides signed written permission.

Appeals. If we deny your request, you may appeal by replying to our decision or emailing [email protected] with “Appeal” in the subject line. If we deny your appeal, you may contact your state Attorney General.

Limits. Some information we hold is governed by the Fair Credit Reporting Act or other financial regulations and may be exempt from deletion or from other state privacy rights. We will tell you if that applies to your request.

California residents. In the preceding 12 months we have collected these categories of personal information: identifiers, commercial information, financial information, internet and device activity, approximate geolocation, audio recordings, professional and employment information, and sensitive personal information including Social Security numbers. The sources, purposes, and recipients are described in Sections 1 through 4.

10. How long we keep information

We keep personal information for as long as it is needed for the purposes described in this Policy. In practice that means we keep it while your application is active and while any funded account remains open, and afterward for as long as we need it to meet legal, regulatory, tax, audit, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. When information is no longer needed for any of these purposes, we delete it or de-identify it.

11. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit and access controls that limit who on our team can view your file. No system is completely secure, and we cannot guarantee absolute security.

12. Children

The Services are intended for businesses and for adults. We do not knowingly collect personal information from anyone under 18.

13. Changes to this Policy

We may update this Policy from time to time. We will post the updated version here with a new “Last updated” date. If we make material changes, we will notify you by email or through a notice on our website before those changes take effect.
